Notice pursuant to articles 13 and 14 of Regulation (EU) 2016/679 – General Regulation on the Protection of Personal Data (GDPR)

In accordance with articles 13 and 14 of Regulation (EU) 2016/679 – General Regulation on the Protection of Personal Data (hereinafter the “GDPR”) , we wish to provide below some information on the processing of the data of the person (hereinafter “User”) who intends to participate in the “Milan Fintech Summit” (hereinafter the “Event”) organised by Fiera Milano S.p.A. and by Fabrick S.p.A.

The Personal Data specified by the User in the Event application form and/or the data provided subsequently by the same, as well those data of the User acquired from third parties (e.g. partners, business information firms, etc.), are gathered and processed by Fiera Milano S.p.A. and by Fabrick S.p.A. as Joint Data Controllers in relation to the conduct of the Event and to the activities performed under their respective authority (hereinafter the “Joint Controllers” or “our Companies”) for the purposes stated below.

PURPOSES RELATED TO PARTICIPATION IN THE EVENT

The User’s Personal Data are processed by the Joint Controllers in order to execute the measures, obligations and services useful for participation in the Event and for payment of the related fee as well as to conduct the related tasks of administration, accounting and tax payment and to discharge the related regulatory obligations.

With respect to the aforesaid purposes, the processing of the User’s personal data is therefore necessary for the making and execution of the contract for participation in the Event, the discharge of the related legal obligations and Fiera Milano S.p.A.’s and Fabrick S.p.A.’s pursuit of their legitimate interests in the conduct of the activities performed under their respective authority as Joint Controllers for the purposes of managing administrative, organisational and technical activities regarding the User’s participation in the Event.Omission, even partial, to provide the personal data requested would preclude the User’s participation in the Event.

For the previously mentioned purposes, the User’s Personal Data: 

a) will be processed with electronic devices, with related, predominantly computer-based procedures and methods suitable for ensuring proper management of the operations and may be stored also subsequent to the Event for administrative, accounting and tax purposes for the periods prescribed by the applicable laws; 

b) may become known by employees and collaborators authorised by our Companies to process data for the conduct of the aforesaid administrative, technical and security tasks in connection with the Event’s organisation and management; 

c) may be conveyed by the Joint Controllers to trusted companies, which provide organisational and technical services concerning the Event such as, for example, organisation office operations, event locations, streaming and matching platforms. Those companies, which conduct the processing of personal data on behalf of ours, operate as data processing officers, in fulfilment of the specific obligations established in the related service contracts;

d) may be transferred to companies located in countries outside the EU provided that the European Commission shall have recognised such countries as having an adequate level of data protection (e.g. Switzerland, Australia, Israel), or on the basis of adequate guarantees (such as the standard contractual clauses or company rules binding for groups), or, absent said conditions, if such transfer is authorised by the User or necessary for the execution of the contract with the User or for the User’s benefit.

ADDITIONAL PURPOSES OF SENDING OF COMMUNICATIONS REGARDING THE EVENT

The e-mail address and that for the delivery of paper-based mail provided by the User for participation in the Event may be used in order to send the Event newsletter and of communications regarding subsequent editions of the Event and of similar events. The User may object, at any moment, to the sending of such communications by contacting either Fiera Milano S.p.A., with registered office in P.le Carlo Magno, 1, 20149, Milan or Fabrick S.p.A. with registered office in Piazza Gaudenzio Sella, 1, 13900, Biella, which operate as Joint Controllers of such processing. Users may also exercise their rights and/or contact the Data Protection Officer (DPO) by sending an e-mail to either of the following addresses: info@businessinternational.it (for Fiera Milano) and privacy@fabrick.it (for Fabrick). A User’s objection shall in no manner affect participation in the Event but may preclude the sending of information, newsletters and communications bearing updates regarding the Event.

Without prejudice to the aforesaid activities of sending by e-mail or post of newsletters and communications relating to the Event and similar events, the Personal Data regarding the User and the information (e.g. electronic contact details) concerning the legal person (company), entity or association on whose behalf the User acts may also be processed by our Companies with the User’s prior consent (to be given by ticking the respective boxes below), for the following additional commercial, marketing or profiling purposes:

a) sending, by Fiera Milano and Fabrick, in the capacity of autonomous controllers, of advertising material; direct sales activities, the conduct of market research or commercial communications by post, telephone, automated call systems, fax, e-mail, text message, mms, web apps and social networks, including as regards additional events, services and products of our Companies, of companies belonging to our respective Groups and of third companies interested in making advantageous business offers to Users;

b) conveying of data to the companies of the Fiera Milano Group (see also the updated list available in the “Company” section of the website www.fieramilano.it), to the companies of the Sella Group to which Fabrick S.p.A. belongs (see also the updated list available at the website sellagroup.eu), to the Event’s Sponsors (see the list available at the website www.milanfintechsummit.com) for their autonomous processing, as data processors, for the purposes and with the procedures as per the foregoing clause a).

Moreover, subject to consent to be given by ticking the respective box (c), the Personal Data of the User (natural person) will be the object of autonomous and distinct processing by our Companies for the analysis of same for identification, including via electronic or automated processing of preferences and of services and products of possible interest to the User (so-called profiling). Without prejudice to the possibility for our Companies to process the Personal Data regarding the User’s economic activities (business or professional), should they be necessary for the pursuit of the respective legitimate interests in connection with the analysis of such activities, also in relation to the User’s participation in the Event, and to their processing in automated form for the monitoring of the quality of services and for the conduct of statistical surveys useful for the development and improvement of our services and activities.

For the aforementioned additional commercial, marketing and profiling purposes, the provision of Personal Data and the consent to their processing are, in any case, optional and the omission of such provision or consent or the partial character thereof shall bear no consequences on the User’s participation in the Event, notwithstanding the data subject’s right to revoke the consent previously given by the same (without prejudice to the lawfulness of processing effected before such revocation on the basis of consent given).

The provisions of the GDPR (articles 15-22) guarantee for each User, as Data Subject (natural person to whom the Personal Data refer), the right of access to the Data concerning him or her at any moment and the right to obtain a copy thereof and to rectify and/or complement same if inaccurate or incomplete, to delete same or to demand the limitation of their processing if the necessary conditions obtain, to object to their processing on grounds in connection to his/her particular situation and, in any case, to their processing for purposes of direct marketing, to demand the portability of data provided when same are processed in an automated manner for the execution of the contract or on the basis of the Data Subject’s consent, as well as to lodge a complaint with the Data Protection Authority for the safeguarding of his/her personal information and rights should he/she deem that they have been infringed.
